Sikap Majelis Kehormatan Kehakiman Terhadap Pelanggaran Kode Etik Oleh Hakim Dalam Putusan Yang Kontroversial

Abstract

The Constitutional Court (MK) Decision No. 90/PUU-XXI/2023 sparked controversy due to allegations of strong political interests and a personal conflict of interest involving the then-Chief Justice of the Constitutional Court, Anwar Usman. This research aims to analyze the stance of the Constitutional Court Honorary Council (MKMK) in enforcing the code of ethics against constitutional justices suspected of violating ethical principles. The research method uses a normative juridical approach with qualitative analysis of legal documents, official news, and MKMK decisions. The results show that the MKMK demonstrated firmness in sanctioning Anwar Usman for violating the principles of impartiality and integrity, and set an important precedent in strengthening ethical oversight. However, the ad hoc nature of the MKMK indicates the need for a permanent ethical institution. This research emphasizes the importance of ethical reform in maintaining the integrity of the Constitutional Court and increasing public trust.
