Abstract

This study aims to analyze the implementation of the New Criminal Code (KUHP) on the effectiveness of the criminal justice system in Indonesia. The background of the study is based on the need for criminal law reform that is more adaptive to social, political, and cultural developments. The research method used is a normative juridical approach with legislative analysis and a comparative study of the old KUHP. Data were obtained through a review of legal documents, academic literature, and interviews with legal practitioners to strengthen the findings. The results show that the New KUHP brings a number of significant changes, particularly in aspects of adjusting criminal sanctions, regulating new crimes, and strengthening the principle of restorative justice. However, the effectiveness of implementation still faces challenges such as limited law enforcement resources, resistance to legal culture, and the need for harmonization with other regulations. This study concludes that the success of the New KUHP in improving the effectiveness of criminal justice depends heavily on consistent implementation, institutional readiness, and public support.
